1. TERMS OF SERVICE

1. Who We Are
SnugHug ("SnugHug," "we," "us," or "our") operates this online store (the "Site") as an individual seller (sole trader), not through a registered corporate entity, unless otherwise stated. You may contact us at helpsnughug@hotmail.com for any questions regarding these Terms of Service ("Terms").

These Terms govern your access to and use of the Site and your purchase of products from SnugHug, including our children's travel neck pillow and related travel comfort accessories (the "Products").

2. Acceptance of Terms / Contract Formation
By accessing the Site or placing an order, you agree to be bound by these Terms, our Privacy Policy, and our Refund & Return Policy. A contract for the sale of Products is formed only when we send you an order confirmation email; adding items to your cart or submitting an order does not by itself create a binding contract. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, pricing errors, or product unavailability, in which case any payment taken will be refunded in full.

3. Products, Pricing & Taxes
All prices are displayed in the currency shown at checkout and are subject to change without notice, though changes will not affect orders already confirmed. Prices do not include import duties, customs fees, or applicable taxes unless explicitly stated at checkout. See our Shipping Policy for details on which party is responsible for duties and taxes for your shipment (currently Delivered Duty Unpaid / Delivered At Place, meaning the recipient is responsible for any customs duties, unless a Delivered Duty Paid option is expressly offered and selected at checkout).

4. Fulfillment Model & Shipping Times
SnugHug works with third-party manufacturing and fulfillment partners to prepare and ship orders; Products may ship from an international origin. Estimated processing time is 2–4 business days, and estimated transit time is 6–10 business days, as detailed in our Shipping Policy. These are good-faith estimates based on information provided by our fulfillment partners and are not guaranteed delivery dates.

5. Intellectual Property
All content on the Site — including the SnugHug name, logo, product photography, graphics, text, and design — is owned by or licensed to SnugHug and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Site content without our prior written consent.

6. Prohibited Uses
You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to our systems; (c) interfere with the Site's operation (including via bots, scraping, or malware); (d) submit false, fraudulent, or abusive orders or reviews; or (e) infringe the intellectual property or privacy rights of SnugHug or any third party.

7. Limitation of Liability
To the maximum extent permitted by law, SnugHug's total liability arising out of or relating to your order shall not exceed the amount you paid for the relevant Product. This limitation does not exclude or limit liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that may not be limited under the laws of your country of residence. Nothing in these Terms affects statutory rights that cannot be waived, including the consumer guarantees described in our Refund & Return Policy.

8. Indemnification
You agree to indemnify and hold SnugHug harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site. In turn, SnugHug remains responsible to you for its own breaches of these Terms and applicable law, including for errors or defects arising from our third-party fulfillment partners.

9. Governing Law & Dispute Resolution
These Terms are governed by the laws of Spain, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence provide otherwise.

• EU / UK customers: you retain the right to bring proceedings before the courts of your country of habitual residence, and you may also use the EU's Online Dispute Resolution platform (ec.europa.eu/consumers/odr) or the UK equivalent. Mandatory arbitration is never imposed as a condition of purchase for EU/UK consumers.
• US customers: disputes may, where legally permitted, be resolved through binding individual arbitration as an optional alternative to court proceedings, at your election.
• Australian customers: nothing in these Terms limits your rights under the Australian Consumer Law, and disputes may be brought before the competent Australian courts or tribunals.

10. Force Majeure
SnugHug shall not be liable for delays or failure to perform resulting from causes beyond our reasonable control, including natural disasters, customs delays, carrier disruptions, labor disputes, or acts of government. Where a delay caused by such an event exceeds a reasonable period, you retain the right to cancel your order and request a refund as described in our Shipping Policy.

11. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

12. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
